Interactive Concepts,
LLC. will agree to render services to the customer /
subscriber, if the select entity agrees
and abides by the following Terms of Service (TOS).
Utilizing any and all services rendered by Interactive
Concepts, LLC. Grants the customer / subscriber accepts all
details listed in the Terms of Service (TOS), Acceptable Use
Policy (AUP) and Privacy Policy.
All aspects detailed in this contract are subject to both
the Terms of Service (TOS), Acceptable Use Policy (AUP) and
Privacy Policy. Interactive Concepts, LLC. reserves the
right to make necessary changes to the provided Terms of
Service (TOS), Acceptable Use Policy (AUP) and Privacy
Policy as needed and without any notice to clients. Changes
to both the Terms of Service (TOS) or Acceptable Use Policy
(AUP) do not apply to contracts terminated early due to
abuse of services or non-payment
Law Enforcement Policy:
Interactive Concepts, LLC. by law is required to report any
and all activities which are considered to be unlawful or
illegal. If any of our services are abused in any manner and
constitutedd as illegal, we reserve
the right to report customer information including ip
information, historical data
(logs), account usage summaries, e-mail addresses, billing
information, etc., to the respective law enforcement
agencies whether a written request
has been authorized or we feel you have
unlawfully
Billing & Payments : If a
given credit card is declined for any any reason, the credit
card owner is subject to a $5.00 processing fee which will
be due before the service is reactivated. Customers are
given a 3-day leniency on billing, allowing for a bill to be
paid 3 days past the due date without late fees being
assessed. After the 3-day period passes all services will be
interrupted and subject to a $10 reconnection charge at our
digression.. If an account is not
paid within 10 days, the account will be subject to
termination without
Refunds & Disputes: All
accounts are subject to a 30 day money-back guarantee in
which, the customer is allowed to receive a full refund for
services, not including any startup, licensing, domain
registration or administration fees. If there is a
discrepancyy in billing, the
customer must report this issue to Interactive Concepts,
LLC. via email at
billing@interactive-concepts.com or phone (888)452-4678
within 60 days. We ask that all customers handle any billing
problems with our company first, before going forward with
an outside entity for charge backs.
Dedicated Servers: Customers
which hold dedicated server accounts with Interactive
Concepts, LLC. are provided with a 15 day money-back
guarantee, if the given customer is not satisfied with
services. The guarantee will be honored fully with the
exception of any startup costs, admin fees, licenses and
overages. If there is a discrepancyy
in billing, the customer must report this issue to
Interactive Concepts, LLC. via email at
billing@interactive-concepts.com or phone (888)452-4678
within 60 days. We ask that all customers handle any billing
problems with our company first, before going forward with
an outside entity for charge backs.
Service / Account
Cancellation: Any and all cancellations should be made via
email 5 days before the next billing cycle. Please send
cancellation requests to
billing@interactive-concepts.com
Support Guidelines:
Interactive Concepts, LLC. will provide support via email,
phone, help desk and live help. Support responses will vary
but no support request will go unanswered. Support does not
constitute programming or any development needs your
individual website requires such as scripts, images or any
other object that may fall into this
category..
Network Uptime Guarantee:
Interactive Concepts, LLC. Agrees to provide a stable
network which is free of any and all network outages.
Upstream problems are outside the realm of out network
uptime guarantee and any problems regarding the network
upstream are handled by the select upstream providers. Our
network uptime guaranteee
Network Outages : An outage is
technically defined by a select service condition that is
below a defined system operational threshold. During an
event, where a network outage is suffered and the customer /
subscriber is unable to access any or all services the
customer will receive a credit based on the network outage
time. Normally network outages will be confirmed by
Interactive Concepts, LLC. during the outage occurrence.
Credit requests for network outages should be delivered
within 10 days of the network outage. All credits are
handled by the billing department feel free to send an email

Scheduled Downtime: In the
event that the Interactive Concepts, LLC. network requires
scheduled downtime, for network equipment replacements,
upgrades or testing a 24 hour notice will be sent via email
or phone. It is the customer / subscriber's responsibility
to provide accurate contact information to receive proper
updates regarding scheduledd
Scripts / Program Policy: If a
given script or program running on a select shared, reseller
or dedicated server account repeatedly causes problems
hindering the network or operations of a select machine, the
account willl
SSH Policy: Interactive
Concepts, LLC. disables all shared hosting and reseller SSH
accounts by default due to security vulnerabilities. If you
require for SSH to be enabled feel free to contact our
support department via phone, live help or help desk. Please
keep in mind you will need to provide a usage statement of
why you need SSH enabled.
Courtesy Backups: Interactive
Concepts, LLC. Provides courtesy backups on a monthly basis
and solely does this as a courtesy based service. In the
event that an account requires company assistance in backup
restoration, one free backup will be given during a calender
month and any additional backup restoration will be charged
at a rate of $30, this fee is non-refundable and must be
paid prior to the service being rendered.
30 Day Money-Back Guarantee:
Interactive Concepts, LLC. Currently provides a 30 day
money-back guarantee on all shared and reseller accounts and
a 15 day money-back guarantee on all dedicated and
collocationn accounts. This fee
does not cover setup, licensing or
administrator
SPAM (ZERO TOLERANCE): We hold
zero tolerance against SPAM. SPAM is anything that falls
under the ream of unsolicitedd
e-mail without the recipients
acceptance or acknowledgment of
receiving it. If any form of Spam
Bandwidth Fees : Bandwidth
overages are billed at $4.00 per (1)GB of overage. All stats
are rounded to the next gigabyte. As a customer you are
required to monitor your own bandwidth usage via your
control panel or select monitoring tools. All bandwidth
overage fees apply to shared, reseller, dedicated and
collocationn based accounts.
Overages not paid before the next billing cycle, will
constitute the select account to be
canceled.
WITH ACCEPTANCE OF THIS TERMS
OF SERVICE (TOS), YOU AGREE THAT INTERACTIVE CONCEPTS, LLC.
IS NOT RESONSIBLE FOR ANY AND ALL LIABILITIES, PENALTIES,
LOSSES, DAMAGES, COSTS, EXPENSES, ATTORNEY / LEGAL FEES AND
ANY OTHER LEGALITY THAT FOLLOWS UNDER THIS STATEMENT CAUSED
BY OR INDIRECTLY FROM YOUR USE OF OUR SERVICES.
ALL LITIGATION WILL BE
GOVERNED BY THE STATE OF CALIFORNIA AND THE DISTRICT COURTS
OF LOS ANGELES.
Warranty of Service: THE
SERVICES, PROVIDED BY INTERACTIVE CONCEPTS, LLC. AND ANY
SITES OR SUBSITES OWNED AND OPERATED BY INTERACTIVE
CONCEPTS, LLC. INCLUDING WIHOUT LIMITATION TO, ALL PRODUCTS,
SERVICES AND IDEAS OFFERED ON THE SELECT VENUE AND ALL TEXT,
CONTENT INCLUDING GRAPHICS, LINKS AND OVERALL CONTENT FLOW
ARE PRESENTED AND RENDERED ON A “COURTESY” BASIS AND WITHOUT
WARRANTY OF ANY KIND. INTERACTIVE CONCEPTS, LLC. DENOUNCES
ALL WARRANTIES, EXPRESSED OR IMPLITED, REGARDLESS OF PURPOSE
or (NON)INFRINGEMENT. WE DO RESPECT THE CLAIMS THAT (1)ALL
SERVICES WILL BE RENDERED VIRUS FREE, (2)SECURITY METHODS
ARE DEPLOYED TO SUSTAIN A STABLE NETWORK INFRASTRUCTURE AND
(3)PROPER PRECAUTIONS WILL BE TAKEN PLACE TO MAKE SURE THE
CUSTOMER EXPERIENCES AN UNINTERRUPTED / ERROR-FREE SERVICE.
Limitation of Liability :
INTERACTIVE CONCEPTS, LLC. WILL IN NO EVENT BE HELD LIABLE
FOR DAMAGES RESULTING FROM LOSS OF DATA, PROFITS, USE OF ANY
SERVICES, OR FOR ANY INCIDENTAL, INDIRECT, PUNITIVE, OR
CONSEQUENTIAL DAMAGES IN CONNECTION WITH THIS AGREEMENT AND
ANY OTHER AGREEMENTS LISTED OR IN DIRECR / INDIRECT
CONNECTION WITH ANY PRODUCTS OR SERVICES PROVIDED HEREUNDER
OR RENDERED FROM AN OUTSIDE SERVICE. IN NO EVENT WILL
CUMULATIVE DAMAGES EVER EXCEED THE PRICE OF A GIVEN HOSTING
ACCOUNT PRODUCT OR SERVICE.
Interactive Concepts, LLC.
Reserves the right to update this Terms Of Service (TOS) and
its own discretion without proper updates to the customer /
subscriber. It is the customer / subscriber's responsibility
to read this policy on an ongoing basis to make sure they
stay within the boundaries of the select service offering..
All staff will enforce this policy on an ongoing basis and
in no way will diverge from these terms at any time. |
